Terms of Service

Last updated: October 9, 2026

Agreement

These terms apply when you create a Swayne account or use swayne.app and the Swayne product (the “Service”). By creating an account or using the Service, you agree to them. If you don’t agree, please don’t use Swayne. Our Privacy Policy explains how we handle your information and is part of how the Service works.

What Swayne Is

Swayne is a creative coaching tool for Instagram creators. With your permission, it reads the posts and performance data of an Instagram professional (Business or Creator) account you connect, analyzes them, and suggests what to do next. Swayne does not post, comment, follow, like, or send messages on your behalf.

Your Account

  • You must provide accurate information and be old enough to enter a binding agreement where you live (and at least 13).
  • You’re responsible for keeping your password secure and for activity that happens under your account.
  • Tell us promptly at the address below if you think someone else has accessed your account.
  • Connect only an Instagram account you own or are authorized to manage.

Connecting Instagram

Connecting Instagram is optional and happens through Meta’s own login flow, subject to Meta’s terms and policies (including Instagram’s Terms of Use and Platform Terms). You can disconnect at any time from Settings, which revokes Swayne’s access. Swayne depends on Meta’s services: if Meta changes, limits, or withdraws access, parts of Swayne may change or stop working, and we are not responsible for Meta’s decisions.

Acceptable Use

You agree not to:

  • Use Swayne to break the law or to violate Meta’s or Instagram’s terms or policies.
  • Connect an account you don’t have the right to connect, or share your login with others.
  • Try to access another user’s data, probe or disrupt the Service, or bypass its security or usage limits.
  • Scrape, copy, or resell the Service or its output at scale, or use it to build a competing product.
  • Use the Service to harass others or to post or promote unlawful, deceptive, or harmful content.

We may limit or suspend access that we reasonably believe breaks these rules.

No Guaranteed Results

Swayne’s suggestions are based on patterns in your own account’s data and are offered as guidance, not guarantees. We can’t promise any particular result — including growth in followers, reach, engagement, income, or any other outcome. Social platforms change constantly and results depend on many factors outside Swayne’s control. You decide what to post, and you’re responsible for those decisions.

Availability and Changes

We work to keep Swayne reliable, but we don’t guarantee it will be uninterrupted or error-free. It may be unavailable for maintenance, updates, or reasons outside our control, including problems with our infrastructure providers or with Meta. We may add, change, or remove features. Swayne is an early product and may change significantly.

Paid Features

Swayne is currently provided without charge. Paid features or plans may be introduced in the future. If that happens, we will describe them clearly before you’re asked to pay, and nothing will be charged to you without your separate, explicit agreement.

Termination

You can stop using Swayne at any time. To have your data deleted, follow the steps on our data deletion page. We may suspend or end your access if you break these terms, if we’re required to by law or by Meta, or if we discontinue the Service; where reasonable, we’ll give you notice. Sections that by their nature should continue (such as the disclaimers and limits below) will continue after your access ends.

Disclaimers and Limits on Liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including that the Service will meet your needs or that its suggestions or analysis will be accurate or complete.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, or any rights you have as a consumer under the laws where you live.

Changes to These Terms

We may update these terms as Swayne evolves. When we make material changes we’ll update the date above and, where appropriate, let you know in the product. Continuing to use Swayne after a change means you accept the updated terms.
